[Modification of Opinion (22 Cal.4th 405).]

THE COURT.- The court's opinion, filed March 6, 2000 (Lane v. Hughes Aircraft Co. (2000) 22 Cal.4th 405), is modified as follows:

On page 412, in the last sentence of the second full paragraph, delete the word "some" and replace it with the word "substantial."

On page 413, in the first complete sentence of the first partial paragraph, add the phrase "under section 657" after the word "that."

This modification does not effect a change in the judgment.

Petition for review after the Court of Appeal reversed a judgment notwithstanding the verdict in a civil case. This case includes issues concerning the standards for appellate review of judgments notwithstanding the verdict and orders grant motions for new trial.
