MODIFICATION OF OPINION
The opinion herein, filed on June 26, 2008, and appearing at 44 Cal.4th 1,
is modified as follows: At the end of the first paragraph on page 61, after the
citation to “People v. Mendoza (2007) 42 Cal.4th 686, 707” the following is
added: “see also People v. Stevens (2007) 41 Cal.4th 182, 212; People v. Lewis
(2008) 43 Cal.4th 415, 521.”
This modification does not affect the judgment.
